US Judge Orders Freedom of Kilmar Abrego Garcia from Immigration Custody
A court has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement lacks legal authority.
"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge stated in her ruling.
The case originates in a mistaken removal to El Salvador in March, which US authorities later acknowledged was an mistake. Following his repatriation to the United States to answer human smuggling allegations, he was held in federal detention.
In her decision, the judge pointed out that the government does not have a valid removal order, which prevents them from removing Mr. Abrego Garcia "at this juncture."
